Enlargement of the EU: Implications for the Community Trade Mark Holder
What you Need to Know
On 1 May 2004 10 new countries joined the EU which means:
- All existing CTM registrations and pending applications (with a filing date prior to the extension) were automatically extended as of right with no need for the applicant or OHIM to intervene.
- Existing CTMs will be effective in the new Member States without any need for translation or further payment.
- Seniority claims may now be possible in respect of earlier national registrations in the 10 countries
