OHIM Trade Mark Application

Set out below are the stages we take your application through when applying for a Community Trade Mark registration on your behalf. Since the Community Trade Mark office is based in Alicante, all arguments must be put in writing. As lawyers we specialise in drafting these arguments taking into account the individual character of OHIM in its decision making.

OHIM Opposition Proceedings

Set out below are proceedings taken out against a trade mark application that threatens the strength of another's earlier rights. As lawyers we are able to take this process from an initial watching service, monitoring other people's applications through to filing, arguing, putting in evidence and, if necessary, appealing cases. We have experience from other jurisdictions in the European Union, whose own application of trade mark law can prove vital in presenting an all-round European answer in infringement proceedings.

For a comprehensive treatment of the CTM system we would refer you to INTA's publication - "The Community Trade Mark" edited by Allan Poulter, partner in our trade marks and brands protection group.
